Exemption 38

Recently the national regulator AMSA (Australian Maritime Safety Authority) has streamlined a number of marine qualifications for ease of compliance. Exemption 38 (low complexity duties) is one of those qualifications supported and recognised by AMSA (Australian Maritime Safety Authority) and state regulators that can fulfil a number of those areas relating to Risk Management and SMS responsibilities for new vessels.

Under AMSA’s definition of Exemption 38, vessel operators with low complexity duties may be exempt from holding a Certificate of Competency if you:

Operate during daylight hours only.

With passengers only operate:

  1. A vessel <12mtrs long with propulsion for an inboard engine  <100kW or outboard engine <250kW.
  2. Within a marina or inland waters.
  3. Within 1 nautical mile from a parent vessel.

Without carrying passengers only operate:

  1. A vessel <12mtrs long with propulsion for an inboard engine  <100kW or outboard engine <250kW.
  2. Within a marina or inland waters.
  3. Within 1 nautical mile from a parent vessel.
  4. In any waters within 1 nautical mile from each point of departure and within 1 nautical mile from the coast.
  5. In any waters of an aquaculture lease, and any approved vessels used for the daily transit to and from the aquaculture lease for operation.
  6. In any waters within 250 meters of a structure fixed to the shore.
  7. In sheltered waters within 2 nautical miles from the coast.

In order to qualify for the exemption, you will need to undertake training with an AMSA (Australian Maritime Safety Authority) approved course provider and complete a Final Practical Assessment Record with an approved trainer assessor.

As an approved training organisation, Maritime and Safety Training NSW (MAST NSW) will be conducting training programs throughout NSW (and interstate by demand) to help you and your staff meet the risk management (RMS) and Safety Management Systems (SMS) as applicable.

MAST NSW has been delivering maritime-associated training for almost 30 years our customers are from both government agencies and private companies. Government agencies include Water NSW, NSW Police, NSW Fisheries, NSW Roads and Maritime, Wyong Council, Australian Fish Management Authority, Hornsby Council and Australian Customs Service.

Program details for Exemption 38 are as follows.

DURATION: 3 - 4 days (depending on numbers)

COST: $1,000 per person, Minimum 10 persons (NSW government training subsidy may be available to cover the cost of this course. Call for details.

LOCATION: as close to (or at) your workplace if possible, but ultimately will depend on numbers.
